Welcome to the Skills PH website. These Terms of Use govern your use of the Site and its contents. The terms “Skills PH” “we,” “us” and “our” refer to Skills PH.

BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE, PRIVACY POLICY AND THE COMMUNITY GUIDELINES POLICY, AND YOU AGREE TO RECEIVE REQUIRED NOTICES REGARDING YOUR ACCOUNT AND TO TRANSACT WITH US ELECTRONICALLY. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE SITE.

1. Creating a Skills PH account/registration
You must register on this Site in order to use certain of the Site functions. Registration is only for demo. During registration, you will be required to provide contact information, consisting of your Full name, Email address, Company name, Contact number, Team size, Your industry, Your role, and Your password. You can use your email address followed by your password to login in our site.

You can select any email address as you like, except that your email address cannot be an impersonation of another person, a term that is the same or confusingly similar to a famous trademark, or a term that is offensive in any way. You may, but are not obligated to, use your own name. If you do use your own name, you consent to it being passed to others by use of certain of the functions of Skills PH. Skills PH reserves the right to reject or remove any email address.

2. Account information and Passwords
When you register, you agree to give us “Registration Information” about yourself that is complete and accurate, and you agree to keep this Registration Information current and accurate. We have the right to suspend or terminate an account and refuse use of the Site if we reasonably suspect such Registration Information is untrue, inaccurate, out-of-date, or incomplete.

Upon registration, you will be asked to create a password. You may not share your password. You are solely responsible for securing and maintaining the confidentiality of your password and account, and you agree to accept responsibility for all activities that occur under your account.

You must (a) immediately notify us of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you logout of your account at the end of each session if using a publicly accessible device. Subject to your compliance with these Terms, Skills PH grants you permission to access and use the Site and Content as set forth in these Terms, and consistent with the intended features and functions of the Site.
3. Skills PH Service
Skills PH is subscription-based online e-learning authorware. Skills PH provides our Customers with the ability to simply and quickly author and publish online e-learning for all devices such as desktop, laptop, ipad, tablet and mobile devices. Skills PH is continually changing and is described in more detail on our website.

4. Limitation of our liability
THE WEBSITE IS NOT AVAILABLE TO (A) ANY USERS PREVIOUSLY SUSPENDED OR REMOVED FROM THE WEBSITE BY Skills PH OR (B) ANY PERSONS UNDER THE AGE OF 13 WHOSE REGISTRATION HAS NOT BEEN APPROVED BY A LEGAL PARENT OR GUARDIAN.

7.1 By clicking the “Sign in” button or by otherwise using or registering an account for the Website, You represent (a) that You have not been previously suspended or removed from the Website by Skills PH; (b) that You are either (i) at least 13 years of age or (ii) Your parent and/or guardian has consented to Your use of the Website; and (c) that your registration and your use of the Website is in compliance with any and all applicable laws and regulations.

7.2 Where we are not legally entitled to exclude our liability, our total liability for any loss or damage relating to us (or to our website generally) shall not exceed an amount equal to the subscription fees which the Customer has paid to us in the previous month.

5. Age of Users
Children under the age of 13 may not use this Site and parents or legal guardians may not agree to these Terms of Use on their behalf. If we become aware that a child under 13 has provided or attempted to provide us with personal information, we will use our best efforts to remove the information permanently from our files.
If you are under the age of 18 but at least 13 years of age, you may use this Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If you are a parent or legal guardian agreeing to these Terms of Use for the benefit of a child between the ages of 13 and 18, be advised that you are fully responsible for his or her use of this Site, including all financial charges and legal liability that he or she may incur.

6. Your Content
6.1 User Content
The Services enable you to share your content, such as homework, quizzes, exams, projects, events and other assignments you submit, posts you make in the forums, messages you sent and the like (“User Content”), with Skills PH, admin, teacher, and student. You retain all intellectual property rights in, and are responsible for, the User Content you share.

6.2 How Skills PH and Others May Use User Content
To the extent that you provide User Content, you grant Skills PH a fully-transferable, royalty-free, perpetual, sublicensable, non-exclusive, worldwide license to copy, distribute, modify, create derivative works based on, publicly perform, publicly display, and otherwise use the User Content. This license includes granting Skills PH the right to authorize participating institutions to use User Content with their registered students and on-campus learners independent of the Services. Nothing in these Terms shall restrict other legal rights Skills PH may have to User Content, for example under other licenses. We reserve the right to remove or modify User Content for any reason, including User Content that we believe violates these Terms.

6.3 Feedback
We welcome your suggestions, ideas, comments, and other feedback regarding the Services (“Feedback”). By submitting any Feedback, you grant us the right to use the Feedback without any restriction or any compensation to you. By accepting your Feedback, Skills PH does not waive any rights to use similar or related Feedback previously known to Skills PH, developed by its employees or contractors, or obtained from other sources.

7. Paid Services
7.1 Billing Policies
Certain aspects of the Service may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms, as we may update them from time to time. Skills PH may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion. Any change to our pricing or payment terms shall become effective in the billing cycle following notice of such change to you as provided in this Agreement.

7.2 Renewals
Skills PH subscriptions renew automatically using the payment details on file for your account. If you purchase a subscription with automatic renewal, you acknowledge and agree that we are authorized to use the payment information on file for the renewal fee. Your subscription will renew monthly or annually on the same day of the month or year, respectively, as the date you made your initial purchase. This date will be included on your subscription confirmation receipt that will be emailed to you at the email you provide. You may cancel your Pro account at any time from within the payments section of your profile. This will stop future subscription charges from accruing to your account.

7.3 No Refunds
You may cancel your Skills PH account at any time; however, there are no refunds for cancellation. Skills PH may offer partial, pro rata refunds for Skills PH’s early suspension, termination, or cancellation of a paid program, where the pricing and payment terms for the specific Skills PH program expressly state that such refunds are available in such scenarios and/or as required by law. In the event that you cancel your account or Skills PH suspends or terminates your account or this Agreement for your breach of this Agreement, you understand and agree that you shall receive no refund or exchange for any Skills PH Indicators, any unused time on a subscription, any license or subscription fees for any portion of the Service, any content or data associated with your account, or for anything else.

7.4 Risk of Loss
All products purchased from or via the Service are transported and delivered to you by an independent carrier not affiliated with, or controlled by, Skills PH. Title to products purchased on the Service, as well as the risk of loss for such products, passes to you when Skills PH or our supplier delivers these items to the carrier.

7.5 Payment Information; Taxes.
All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.

8. Quality Assurance
Quality Assurance Department’ signifies the part of the Skills PH’s organizational structure with the mission to guard and evaluate the quality of Product and service provided.

9. No guarantees
We make no guarantee that the Company will be suitable for your intended use, neither do we guarantee that it will be error-free, timely, reliable, entirely secure, virus-free or available, especially since we are dependent on the reliability of the Internet and your use of your own computer to access the Company.
